Anti-union group challenges Obama labor board recess appointments
Published January 13, 2012 | Associated Press
WASHINGTON – An anti-union group has filed the first legal challenge to President Obama's controversial recess appointments.
The National Right to Work Legal Defense Foundation argues Obama cannot legally bypass the Senate to appoint three members to the National Labor Relations Board.
The group makes the argument in federal court, where it's already suing the labor board over a requirement that businesses to put up posters telling workers about their right to form a union.
Obama stoked controversy earlier this month, when he squeezed in the appointments during a short break between Senate sessions. Obama also used the move to appoint the first director of the Consumer Financial Protection Bureau after his confirmation stalled in the Senate.
Republicans call the move an unconstitutional power grab.
